Introduction

Eduquiz Techno Inspire Pvt. Ltd. (“Company”, “we”, “our”, “us”) operates the brand TestWin Academy (“TestWin”), an educational technology platform that provides online test, assessment, and contest based learning services across a wide range of competitive examinations and school board assessments (collectively, the “Services”).

By registering, accessing, or using our website, mobile applications, or any related platforms, you agree to comply with this User Policy and all applicable laws and regulations.

Please read this document carefully before using our Services, as it outlines your rights, responsibilities, and acceptable use obligations as a user of TestWin Academy.

1. User Consent and Agreement

By creating an account or using TestWin Academy’s Services, you:

    • If you do not agree with any part of this Policy or related terms, you must discontinue use of our Services immediately.

    2. Account Creation and Responsibilities

    To access the full features of our Services, users must register for an account on the TestWin Academy platform.

    You agree to:

  • •Maintain the confidentiality of your login credentials and be solely responsible for all activities conducted under your account.
  • •Promptly update your account details (such as email address, contact number, or preferences) whenever changes occur.

    • The Company reserves the right to suspend or terminate any account that provides false information, violates this Policy, or engages in fraudulent, abusive, or unethical conduct.

    3. Use of Services

    TestWin Academy grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services solely for personal, educational, and non-commercial purposes in accordance with this User Policy.

    You may use our Services to:

  • •Attempt practice tests, quizzes, and contests designed for learning and assessment.
  • •Access study materials, performance analytics, progress reports, and learning insights.
  • •Participate in learning communities, discussion forums, or doubt-clearing sessions where available.

    • You must not:

  • •Share, reproduce, sell, or distribute test questions, content, or proprietary materials without prior written permission.
  • •Cheat, impersonate others, or use unfair means during online tests or contests.
  • •Use bots, scripts, or automated tools to manipulate test results, scores, or leaderboards.
  • •Attempt to hack, disrupt, probe, or overload our platform or interfere with other users’ access.
  • •Post, upload, or share any defamatory, obscene, abusive, or unlawful content on the platform or its forums.

    • Violation of these guidelines may result in immediate suspension, disqualification from contests, or permanent termination of your account, along with possible legal action as permitted under applicable law.

    4. Intellectual Property Rights

    All content available on the TestWin Academy platform — including, but not limited to, test questions, study materials, videos, software, code, user interfaces, graphics, designs, logos, trademarks, and analytics reports — is the intellectual property of Eduquiz Techno Inspire Pvt. Ltd. or its respective licensors and content partners.

    You are granted a limited, non-exclusive, non-transferable license to access and use such content solely for your personal learning and educational purposes in accordance with this Policy.

    Any unauthorized copying, reproduction, distribution, modification, reverse engineering, public display, or commercial exploitation of our materials, content, or technology is strictly prohibited and may result in account termination and/or legal action under applicable intellectual property laws.

    5. Contest Participation Rules

    When participating in any online contest, test, or competition hosted by TestWin Academy, you agree to comply with all contest-specific rules, instructions, and conditions.

    Participants must:

  • •Follow all instructions, eligibility criteria, and technical requirements provided for each contest.
  • •Avoid using any unauthorized materials, external aids, or prohibited tools during contest sessions.
  • •Adhere to all time limits, proctoring guidelines, and integrity standards to ensure a fair testing environment.
  • •Acknowledge that all scores, rankings, leaderboards, and rewards (if applicable) are determined through fair, system-based evaluation and subsequent verification by TestWin Academy.

    • The Company reserves the right to disqualify, suspend, or permanently ban any participant suspected of malpractice, impersonation, false identity, or violation of contest rules or terms.

    Decisions of TestWin Academy regarding rankings and awards are final and binding.

    6. Payments and Refunds

    Certain Services offered by TestWin Academy, such as premium tests, contests, or subscription-based features, may require payment of applicable fees.

    Payment Terms:

  • •All payments must be made through our authorized and secure payment gateways only.
  • •Transactions are final and non-refundable unless otherwise stated under a specific Refund Policy or required by applicable law.
  • •Any eligible refunds, where applicable, will be processed strictly in accordance with Company guidelines and statutory requirements.

    • TestWin Academy does not collect or store your full credit/debit card numbers, CVV, or UPI PINs.

    All payment processing is handled by trusted PCI-DSS-compliant payment partners to ensure safety and confidentiality of your financial information.

    7. Data Privacy and Security

    Your privacy is of utmost importance to us. TestWin Academy follows the principles of the Digital Personal Data Protection Act, 2023 (DPDPA) and other applicable data protection laws governing the collection, processing, storage, and retention of personal information.
    We implement appropriate technical and organizational safeguards to protect your data from unauthorized access, disclosure, or misuse.

    8. User-Generated Content and Conduct

    Users may share posts, feedback, questions, or comments on our discussion forums, chat rooms, or interactive features available on the platform.

    You are responsible for:

  • •Avoiding the use of hate speech, abusive, obscene, or misleading language.
  • •Not uploading, sharing, or reproducing copyrighted or proprietary material without properauthorization.

    • The Company reserves the right to moderate, edit, or remove any content that violates these guidelines, our policies, or applicable laws. Repeated violations may result in suspension or termination of account access.

    9. Platform Availability and Technical Limitations

    TestWin Academy strives to ensure reliable, secure, and uninterrupted access to its Services. However, the Company does not guarantee that the platform will be:

  • •Continuously available, free from errors, or immune to viruses and other harmful components.
  • • Unaffected by delays, technical faults, or downtime due to maintenance, updates, or unforeseen circumstances beyond our control.

    • The Company may perform scheduled maintenance or system upgrades that may temporarily affect availability. In such cases, reasonable efforts will be made to notify users in advance.

    Eduquiz Techno Inspire Pvt. Ltd. shall not be liable for any data loss, interrupted access, or other damages resulting from service disruptions, network failures, or third-party system errors.

    10. Suspension or Termination of Access

    Eduquiz Techno Inspire Pvt. Ltd. reserves the right to suspend, restrict, or permanently terminate any user account or access to the TestWin Academy platform, with or without prior notice, if:

  • •You violate this User Policy, Privacy Policy, or any applicable law or regulation.
  • •You engage in fraudulent, deceptive, or harmful activities that threaten platform integrity or other users.
  • •You misuse intellectual property, share proprietary content, or attempt to compromise platform security.

    • Upon termination, your account and associated data may be deactivated or deleted, subject to legal retention requirements. Access to ongoing tests, results, or rewards may also be forfeited.

    If you believe your account was terminated in error or wish to request reinstatement, you may contact our Grievance Officer.

    11. Acceptable Use Policy

    To ensure a safe, fair, and effective learning environment, users must use TestWin Academy’s platform and Services responsibly and lawfully. By accessing or using our Services, you agree to comply with the following Acceptable Use Policy.

    A. Prohibited Content

    You agree not to upload, share, or publish any content that:

  • •Is sexually explicit, obscene, or pornographic in nature.
  • •Promotes or depicts violence, self-harm, exploitation, or injury to any person or animal.
  • •Targets or seeks to exploit minors by exposing them to inappropriate content or soliciting personal data.
  • • Violates any law, regulation, or third-party right, including intellectual property or privacy rights.
  • • Contains hate speech, discriminatory, defamatory, harassing, or offensive material.
  • •Is fraudulent, misleading, or deceptive, including false claims or impersonation.
  • •Discloses confidential, proprietary, or trade secret information without authorization.
  • •Encourages or incites any unlawful or unethical activity.

    • B. Prohibited Activities

    You agree not to engage in any activity that: :

  • •Attempts to hack, probe, or test the vulnerability of the platform or its security systems.
  • •Uses bots, scripts, crawlers, or automation tools to access or manipulate Services, data, or leaderboards.
  • •Circumvents or disables security or proctoring measures, or attempts to cheat during any test or contest.
  • •Mirrors, frames, copies, or redistributes TestWin Academy’s content, branding, or proprietary materials without prior written consent.
  • •Engages in spam, phishing, or mass unsolicited communication to users.
  • •Interferes with the functioning of the platform, including by uploading malware, viruses, or performing denial-of-service attacks.
  • •Collects or stores personal information about other users without their explicit consent.
  • •Impersonates another person, user, or organization, or misrepresents affiliation with TestWin Academy.
  • •Uses the platform for unauthorized commercial purposes or resells access to Services.
  • •Shares account credentials or access with others to bypass individual subscription requirements.

    • C. Enforcement and Consequences

    Eduquiz Techno Inspire Pvt. Ltd. reserves the right to:

  • •Remove or restrict any content that violates this Acceptable Use Policy or other applicable terms.
  • •Suspend or permanently terminate user accounts found engaging in prohibited conduct.
  • • Report unlawful activities to appropriate authorities and cooperate in investigations.

    • Violation of this policy may lead to loss of access, disqualification from contests, forfeiture of rewards, or legal action, as deemed appropriate by the Company.

    TestWin Academy reserves the right, but is not obligated, to review, monitor, or remove any User Content at its sole discretion, whether or not such content violates this Acceptable Use Policy, the Terms of Service, or any applicable law.

    The Company may also, at its sole discretion, suspend, restrict, or permanently terminate any user account — with or without prior notice — if it determines that:

  • •The user has violated any clause of this Policy or the Terms of Service.
  • •The user’s conduct may harm the integrity, reputation, or security of the platform or other users.
  • •Such action is necessary to comply with legal or regulatory obligations.

    • TestWin Academy shall not be liable for any loss, damage, or inconvenience resulting from such removal, suspension, or termination of access.
